Effective Date: 1/16/2025
1. Introduction
The Whale Defense Agency (WDA) is committed to advancing our mission to protect whales from the catastrophic impacts of whaling through innovative, direct action, technology development, and covert operations. This Terms of Service governs your use of the WDA website. By accessing or continued use of this website, you agree to abide by these Terms of Service. If you do not agree to these terms, you are not authorized to use this website any further and must leave now. Continued use is construed as your acceptance of these terms and conditions outlined in our Terms of Service.
2. Website Access and Restrictions
The WDA website is intended solely for anti-whaling purposes. Access to this website is strictly prohibited for individuals, entities, or representatives associated with the whaling industry, including but not limited to whalers, government officials involved in the support of whaling, private defense lawyers for whaling operations, and any entity or individual providing operational, strategic, financial, press and media, or legal support to whaling interests that defy international law.
3. Ban on Whalers and Whaling Support
By accessing this site, you acknowledge and agree that the Whale Defense Agency may, at its sole discretion, block, disconnect, or disrupt access to the site for any individual, entity, or organization identified as supporting whaling. This includes whalers and any other related actors. WDA reserves the right to alter, modify, or block specific pages or sections of the website and to deliver altered information to the whalers in real time, and may do so at any time, for any reason, to protect our mission and volunteers.
The WDA may suspend or terminate access to the website for any users identified as an active or passive threat to the safety and security of WDA personnel or the mission.
4. Intelligence Collection and Profiling
As part of our mission to protect whales and the safety of our personnel, the WDA may collect, track, and store information about users who access this website. This data collection includes but is not limited to IP addresses, geographic locations, browsing habits, and digital footprints. This information may be used to build threat-based profiles of whalers, pro-whalers, and any individual who seeks to undermine our efforts.
Such profiles may include personal, social, and professional data, gathered through open-source intelligence tools capable of mass-data mining of the entire digital footprint of whaling operators, crew, leadership, and captains from the past to the present day. Data related to whalers and their affiliates may be stored indefinitely and shared with international law enforcement, partners, and anti-whaling enforcement agencies like WDA, as needed to advance the WDA’s anti-whaling mission. This information is also used to enhance operational security and strengthen anti-whaling enforcement efforts.
WDA reserves the right to share intelligence with other organizations working on similar missions, to create joint enforcement actions, or to integrate this data into international anti-whaling databases.
5. No Assumption of Privacy for Whalers
Whalers, their affiliates, and those who support or conduct whaling operations have no right to privacy when visiting WDA websites. This includes individuals who have been identified as having a connection to illegal whaling activities or those who engage in physical violence or threats against anti-whaling efforts (such as ramming ships, using steel cables, or sinking ships, like the Ady Gil incident).
The WDA will use all necessary means to monitor and track individuals who are considered threats to the safety and security of our mission. This includes using intelligence collection and surveillance tools, which can link online activities to physical identities, mapping a user’s entire life-based digital footprint. We can see a post a whaler posted 16 years ago, and to them it is no longer a thing that exists, but for our intelligence tools, it is easy to collect this mass amount of intelligence data in just minutes and develop a profile on a user. It is so powerful, that Interpol uses the same software to track criminals, and build profiles and data on them. Users who are identified as being associated with the whaling industry agree to the collection and use of their data in this manner.
6. Defense Against Piracy and Hostile Actors
The Whale Defense Agency considers any individual or group that engages in violent actions against our mission, or threatens our personnel, to be a hostile actor. These actions include, but are not limited to, acts of piracy, physical harm, intimidation, harassment, or any form of aggressive or unlawful action.
WDA reserves the right to take all necessary measures to defend itself, its personnel, and its operations from such threats, including blocking access to the website or other disruptive actions. We are not obligated to gauge the threat level before taking action and will use any information available to protect the safety of our team.
7. Use of Website for Anti-Whaling Purposes
This website is dedicated to the anti-whaling mission and may only be used for legitimate anti-whaling purposes. Any user accessing this site agrees not to use it in a way that threatens the safety, freedom, or operational effectiveness of WDA personnel, volunteers, or affiliated entities.
Users are prohibited from using this website to gather intelligence for the whaling industry or any other purpose that could potentially endanger lives, obstruct our efforts, or compromise the integrity of WDA operations.
8. Legal Defense of WDA
By using this website, you agree to indemnify, defend, and hold harmless the Whale Defense Agency, its employees, affiliates, volunteers, and agents from any and all claims, damages, losses, liabilities, or legal costs that arise from your violation of these Terms of Service. You further agree that WDA shall not be liable for any damages or losses that result from actions taken to defend its mission, including but not limited to blocking access to the website, collecting intelligence, or taking any other defensive actions.
9. Modifications to Terms of Service
WDA reserves the right to modify these Terms of Service at any time, at its sole discretion. All changes will be posted on this page with an updated effective date. By continuing to access or use this website after such modifications, you agree to be bound by the updated terms.
10. Governing Law
